The legal basis for processing based on consent is Article 6(1)(a) of the GDPR.

Where the processing of personal data is necessary for the performance of a contract to which the data subject is a party, Article 6(1)(b) of the GDPR serves as the legal basis. This also applies to processing operations necessary for the implementation of pre-contractual measures.

Only personal data that is absolutely necessary is collected. Furthermore, Mittweida University of Applied Sciences has implemented all necessary, suitable and appropriate technical and organisational measures to comply with data protection regulations. To protect the transmission of confidential content, the Mittweida University of Applied Sciences website uses SSL or TLS encryption. This can be recognised by the encrypted connection in the browser’s address bar and the padlock icon in the browser bar. Where, in the course of processing, data is disclosed to other individuals and organisations (data processors and third parties), transferred to them or access to the data is otherwise granted, this takes place only on the basis of a legal authorisation (Article 6(1), (b) of the GDPR), where consent has been given, where a legal obligation so requires, or on the basis of the legitimate interests of Mittweida University of Applied Sciences.

Where third parties are commissioned to process data, this is done on the basis of Article 28 of the GDPR.

Where data is processed in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)), or where this occurs in connection with the use of third-party services or the disclosure or transfer of data to third parties, this shall only take place where it is necessary to fulfil (pre-)contractual obligations, on the basis of consent, due to a legal obligation or on the basis of the legitimate interests of Mittweida University of Applied Sciences.

The personal data entered by the data subject is collected and stored exclusively for internal use by the data controller. Where web portals are operated on behalf of Mittweida University of Applied Sciences by partners or data processors, this is specified in the terms of use of the respective web portals. In such cases, this external operator is also the recipient of the data stored therein. From the contact forms used, it can be determined from the respective context who is intended to be the recipient of the message. Where necessary, relevant enquiries may be forwarded for the purpose of carrying out the task.

The data subject’s registration, involving the voluntary provision of personal data, enables the data controller to offer the data subject content or services which, by their very nature, can only be made available to registered users. Registered users are free to amend the personal data provided during registration at any time or to have it completely deleted from the data controller’s database.

10. Use of video conferencing services:

Staff and students of Mittweida University of Applied Sciences, as well as external individuals, may use video conferencing services.

The video conferencing services are used, as part of the digitalisation process, to fulfil those tasks of Mittweida University of Applied Sciences which are assigned to it under Section 5 of the Saxon Higher Education Act (SächsHSG) in conjunction with the relevant implementing regulations. These include, in particular:

• the management of employment relationships and organisational and personnel measures
• Maintaining teaching operations and conducting courses and examinations
• Communication with external partners
• Research projects/conducting research

The legal bases for the processing of personal data in this context are:

• in the context of the employment relationship: Article 88 of the GDPR in conjunction with Section 11 of the Saxon Data Protection Act (SächsDSDG) and Section 15 of the Saxon Higher Education Act (SächsHSG)
• for applicants: Article 6(1)(a) of the GDPR, provided an alternative means of communication is specified
• in teaching: Article 6(1)(e) of the GDPR in conjunction with Section 5 of the Saxon Higher Education Act (SächsHSG)
• for examinations: Article 6(1)(a) of the GDPR, with an alternative communication method specified
• when communicating with external parties: either Article 6(1)(a) of the GDPR, specifying an alternative means of communication, or, where a contract exists with the external party, Article 6(1)(b) of the GDPR
• for research: Article 88 of the GDPR in conjunction with the University’s Regulations on the Processing of Personal Data

In order to fulfil the aforementioned tasks, the following personal data is processed for the purpose of conducting and participating in video conference meetings:

• Master data (first name and surname, email address, identifier, rights, roles, group membership, status, department, optional profile details, language settings, approximate geographical location)
• Communication-related metadata (telephone number and country of residence when dialling in by telephone, meeting title, meeting description, start and end times of the communication, participants joining the meeting, IP address, device/hardware/browser information such as MAC address, device ID, device type, operating system details, etc.)
• Communication content (optional) (text, audio, image and video transmission, file transfers, audio and video recordings of communication content in the cloud)

The master data listed above will be deleted upon account deletion (or deletion of the account at the request of the data subject).

Communication-related metadata is deleted as soon as its storage is no longer necessary for the provision or maintenance of the service.

The following recipients of the data are used, or the following data transfers take place:

Mittweida University of Applied Sciences supports and uses video conferencing services provided by Zoom X, MS Teams and BigBlueButton. The personal data mentioned is transferred to the provider Zoom X powered by Telekom, which has data centres in Germany and the EU. Communication data within MS Teams is processed on servers within the EU. The processing of personal data via BigBlueButton takes place exclusively on servers within the university.

Mittweida University of Applied Sciences has concluded the relevant data processing agreements with the service providers in accordance with Article 28 of the GDPR.

11. Integration of third-party services and external links:

The Mittweida University of Applied Sciences’ online offering incorporates third-party content, e.g. from YouTube, map data from Google Maps and the Google search engine. This requires the providers of this content to collect users’ IP addresses. The IP address is therefore necessary for the display of this content. Mittweida University of Applied Sciences has no control over whether the third parties whose content is integrated store the IP address for other purposes, e.g. for statistical purposes. Where direct or indirect reference is made to linked sites (“links”) that fall outside the scope of responsibility of the data controller, the data controller shall only be liable if it is aware of the content and it would be technically possible and reasonable for it to prevent use in the event of unlawful content. It is hereby expressly stated that the responsible party has no influence whatsoever on the design and content of the linked pages. The responsible party therefore hereby expressly distances itself from all content on any linked pages that has been altered since the link was established.

Liability for any further content, and in particular for any damage arising from the use or non-use of such information, lies solely with the provider of those pages, and not with the party who merely refers to the relevant publication via links.

12. Use of cookies/Google Analytics:

We use cookies to make our website more user-friendly, effective and secure. Some elements of our website require that the browser used to access the site can be identified even after a page has been changed. We also use cookies on our website that enable us to analyse users’ browsing behaviour.

The cookie banner contains settings for essential cookies, external services and content, and for marketing and statistical purposes (analytics cookies).

The purpose of using technically necessary cookies is to simplify the use of websites for users. Some functions of our website cannot be provided without the use of cookies. For these, it is necessary for the browser to be recognised even after a page has been changed. The user data collected by technically necessary cookies is not used to create user profiles. As the website operator, we have a legitimate interest in storing cookies to ensure the technically error-free and optimised provision of our services (Article 6(1)(f) of the GDPR).

The data collected from users is pseudonymised through technical measures. Consequently, it is no longer possible to link the data to the user accessing the site. The data is not stored together with any other personal data relating to the users.

When accessing the university’s website, users are informed via an information banner about the use of cookies and external services and content, and are directed to the privacy policy. At the same time, they are asked to give their consent to the use of cookies and to external services and content to the extent described above, by means of a clear affirmative action through which the data subject indicates that they consent to the processing of their personal data (opt-in). Consent is voluntary and may be withdrawn at any time. However, we would like to point out that if consent is not given or is withdrawn, you may not be able to make full use of all the functions of this website.

The legal basis for the processing of personal data via technically necessary session cookies, on the other hand, is Article 6(1), first sentence, point (f) of the GDPR (legitimate interests). As the operator of this website, we have a legitimate interest in storing cookies to ensure the technically error-free and seamless provision of our services. This applies, for example, to enabling us to provide functions you have selected (e.g. language settings, login status, etc.).

13. External services and content:

The use and processing of personal data in connection with the services and content of our website listed below is based on your consent in accordance with Article 6(1), first sentence, point (a) of the GDPR, subject to the conditions set out in point 7, which can be granted individually via the information/cookie banner on our website.

a) Use of Google reCAPTCHA:

Google reCAPTCHA is used on the Mittweida University of Applied Sciences website to secure our IT systems and to protect against automated form submissions. 

b) Use of Google Maps:

To make it easier to locate the places listed on the website, Mittweida University of Applied Sciences uses the ‘Google Maps’ service to display an interactive map. Google Maps is operated by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. When you access Google Maps, data is transferred to Google in the USA, which Google uses for its own purposes. If you wish to prevent Google from linking usage data to your user account, you must log out of your Google account before accessing the service. The ‘Google Custom Search’ (Google Custom Search Engine) function is used on the university’s websites. Data entered into the search box is transmitted to Google in the USA, together with your IP address, once you press the Enter key or click on the search icon (magnifying glass symbol). Google uses this data for its own purposes and is itself responsible for it under data protection law. d) Use of Brevo:

The Brevo service is used on the university’s website for the registration and delivery of email newsletters and a chat service. Brevo stores personal data on servers in Germany. A data processing agreement (Article 28 of the GDPR, paragraph 7) has been concluded. Newsletter subscriptions are processed exclusively via a double opt-in procedure (subscription is only confirmed after clicking the link in the confirmation email). e) Use of Vimeo:

Mittweida University of Applied Sciences uses the Vimeo service. Vimeo is a video platform based in the USA, similar to YouTube. Videos can be embedded on the website, whereby data is loaded from external servers. Further information is available at

The Mittweida University of Applied Sciences website uses plugins from YouTube, a service operated by Google. When you visit one of our pages featuring a YouTube plugin, a connection is established with YouTube’s servers in the USA. Eye-Able® is software developed by Web Inclusion GmbH to ensure that everyone has barrier-free access to information on the internet. The necessary files, such as JavaScript, style sheets and images, are loaded locally from this website. When functions are activated, Eye-Able uses the browser’s local storage to save the settings. All settings are stored locally only and are not transmitted further.

The use and processing of personal data in connection with the analytics services listed below for marketing and statistical purposes on our website is based on your consent in accordance with Article 6(1), first sentence, point (a) of the GDPR, subject to the conditions set out in section 7, which can be granted individually via the information/cookie banner on our website.

Analytics cookies (marketing and statistics) are used for the purpose of improving the quality of our website and its content. These analytics cookies enable us to understand how the website is used, allowing us to continuously optimise our offering.

a) Use of Google Analytics, Google Analytics 4:

The Mittweida University of Applied Sciences website uses Google Analytics and Google Analytics 4, a web analytics service provided by Google Inc. (‘Google’). This service enables adverts to be optimised and thus serves to improve the online offering.

When you click on an advert placed by Google, a conversion tracking cookie is set. Each Google Ads customer is assigned a different cookie. The cookies cannot be tracked across the websites of Ads customers. The information collected using the conversion cookie is used to compile conversion statistics.

c) Use of Google Tag Manager:

This service is a script loaded by Google, through which further scripts can be integrated. The provider is also Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States. d) Use of Facebook Ads Tracking (Pixel):

Facebook Ads is a service that allows you to create adverts for Facebook and Instagram. The Facebook Ads Tracking Pixel is a script used to measure the success of these adverts. The provider is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. Further information on Facebook can be found in section 15.

15. Social media services:

Communication is evolving, and with it, the channels and methods used to reach target audiences are also changing. Against this backdrop, Mittweida University of Applied Sciences provides a wide range of social media services on its website.

Part of Mittweida University of Applied Sciences’ press and public relations work involves reaching as many target groups as possible in a tailored manner; consequently, the use of various communication channels and methods – and, in particular, newer communication channels (social media) – is essential. It is precisely here that our legitimate interests lie in being permitted to process your personal data in this context, in accordance with Article 6(1), first sentence, point (f) of the GDPR.

a) Facebook:

The Mittweida University of Applied Sciences website offers the option to use the social network facebook.com, which is operated by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. The plugins may display interactive elements or content (e.g. videos, graphics or text posts) and can be recognised by one of the Facebook logos (a white ‘f’ on a blue tile, the terms ‘Like’, ‘gefällt mir’ or a ‘thumbs-up’ symbol) or are labelled with the words ‘Facebook Social Plugin’.
